Concretely, the general tax rate for Stamp Tax is increased from 1.2% to 1.5%. In this sense, for instance, the formalization under a public deed of a mortgage guarantee will have an extra cost, as from 24 March 2012, of 0.3% over the value of the guaranteed capital, including the amounts that are guaranteed for interest, indemnities, penalties for non-fulfilment and other analogue concepts.
Besides, the special tax rate that applies for Stamp Tax in cases that are related with the sale of real estate in which the seller renounces to VAT exemption, assuming all of the requirements are met, is increased from 1.5% to 1.8%. Therefore, the tax cost related to the sale & purchase of real estate between entrepreneurs of professionals is increased in 0.3%.
